The employment law practice is headed by attorneys who have practiced employment law for over twenty years and have represented both private and public clients in many high profile cases. The Firm provides employment representation, as well as training on various employment issues to our clients. We have considerable experience in providing legal advice to public entities on a broad range of employment law issues.
Having developed firsthand an appreciation of the risks, costs and disruption caused by litigation, the Firm’s employment lawyers spend a significant portion of their time assisting clients in the prevention of litigation. These counseling efforts include the provision of ad hoc advice on compliance with federal and state employment laws, as well as periodic training of managers, supervisors, and human resource professionals for our public and private clients. In addition, the Firm provides day-to-day advice on topics including: employee benefits, disciplinary actions, substance abuse and compensation.
The Firm’s employment lawyers also spend a significant portion of their time advising clients on changes in employment laws and assisting them to obtain compliance with these changes. The Firm has worked with several of its clients to become compliant with the recently amended Health Insurance Portability and Accountability Act of 1996 (HIPAA) Privacy Rule, a law governing the way an employer gathers and uses employee health information. The Firm also provided HIPAA training to managers and supervisors on the Privacy Rule.
Federal law has a substantial impact on the formation of personnel policies and the handling of litigation that flows from personnel issues. The federal statutes encountered most often in this regard are Title VII of the Civil Rights Act of 1964, the Americans with Disabilities Act, and the Family and Medical Leave Act. The Firm routinely defends clients from EEOC complaints alleging violations of these federal statutes.
