Environmental Law

The Firm has provided its expertise in environmental laws to clients in two major areas: real estate transactions and regulatory counseling. In real estate transactions, the Firm has experience in all environmental-related matters in the sale, acquisition and leasing of real estate, as well as real estate loans. Services include review of environmental site assessments, negotiation with environmental consultants, representation of clients before governmental agencies, and drafting and review of transactional agreements such as environmental indemnification agreements, site access agreements, consultant agreements, and settlement agreements. The Firm also helps clients identify potential environmental liabilities and counsel them on how to minimize such risks.

In the Firm’s regulatory counseling practice, it provides guidance to clients on applicable environmental laws and regulations, and educates them on new and pending regulations. Attorneys in the Firm also have experience in environmental litigation involving governing agencies such as the United States Environmental Protection Agency and North Carolina Department of Environment and Natural Resources, as well as citizen suit enforcement actions.
